1. Agreement to Terms
By accessing and using the services of Great White Electrical ("Company," "we," "our," or "us"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
2. Nature of Service - Lead Generation & Referral
IMPORTANT NOTICE: Great White Electrical operates as a lead generation and referral service. We connect customers with qualified, licensed electrical contractors in the Perth area.
2.1 What We Do
Great White Electrical provides the following services:
- Customer inquiry management and lead generation
- Referral services connecting customers with licensed electrical contractors
- Initial consultation and requirement gathering
- Facilitating connections between customers and qualified electricians
2.2 What We Do NOT Do
Great White Electrical does NOT:
- Directly perform electrical work or installations
- Employ electricians or electrical contractors
- Hold an electrical contracting license (at this time)
- Provide warranties or guarantees for work performed by third-party contractors
- Control or supervise the electrical contractors we refer
2.3 Independent Contractors
All electrical work is performed by independent, licensed electrical contractors who are not employees or agents of Great White Electrical. These contractors:
- Hold their own electrical licenses and qualifications
- Carry their own insurance and liability coverage
- Set their own pricing and terms
- Are solely responsible for the quality and safety of their work
- Operate as independent businesses
2.4 Customer-Contractor Relationship
When we refer you to a contractor, you enter into a direct contractual relationship with that contractor. Great White Electrical is not a party to that agreement and assumes no responsibility for the contractor's work, pricing, scheduling, or conduct.
3. Referral Process and Contractor Quotes
3.1 Referral Service
When you contact Great White Electrical, we will gather information about your electrical needs and refer you to one or more licensed electrical contractors in our network.
3.2 Contractor Pricing
All pricing for electrical work is determined by the independent contractor, not by Great White Electrical. Contractors will provide their own quotes directly to you. We have no control over contractor pricing and are not responsible for:
- The accuracy of contractor quotes or estimates
- Price variations or increases
- Additional costs discovered during work
- Payment terms set by contractors
3.3 No Guarantee of Availability
While we maintain relationships with multiple contractors, we cannot guarantee that a contractor will be available for your project or will accept your job.
4. Booking and Scheduling
Service bookings can be made via phone, email, or through our website. We will confirm your booking and provide an estimated arrival time. While we strive to meet all scheduled appointments, times are approximate and may be subject to change due to:
- Previous job overruns
- Emergency call-outs
- Weather conditions
- Traffic or unforeseen circumstances
We will notify you as soon as possible if your appointment needs to be rescheduled.
5. Payment and Fees
5.1 No Referral Fee to Customers
Great White Electrical does not charge customers a fee for our referral service. Our service is free to use for customers seeking electrical services.
5.2 Contractor Payments
All payments for electrical work are made directly to the contractor you engage. Payment terms, methods, and schedules are determined by the individual contractor. Great White Electrical does not:
- Receive or process payments for electrical work
- Set payment terms or conditions
- Act as an intermediary for financial transactions
- Have any involvement in payment disputes between customers and contractors
6. Cancellations and Rescheduling
6.1 Customer Cancellations
If you need to cancel or reschedule an appointment, please provide at least 24 hours' notice. Cancellations with less than 24 hours' notice may incur a cancellation fee.
6.2 Company Cancellations
If we need to cancel or reschedule your appointment, we will provide as much notice as possible and work with you to find an alternative time.
7. No Warranties or Guarantees from Great White Electrical
7.1 Contractor Responsibility
Great White Electrical provides NO warranties or guarantees regarding:
- The quality of work performed by referred contractors
- The qualifications or competence of contractors
- The timeliness or completion of electrical work
- Materials or products used by contractors
- Contractor compliance with regulations or standards
7.2 Contractor Warranties
Any warranties or guarantees for electrical work are provided solely by the individual contractor you engage, not by Great White Electrical. You should discuss warranty terms directly with your chosen contractor.
7.3 Referral Service Only
Our sole responsibility is to facilitate introductions between customers and contractors. We make no representations about the suitability of any contractor for your specific needs.
8. Customer Responsibilities
As a customer, you agree to:
- Provide safe and reasonable access to work areas
- Disclose any known electrical issues or hazards
- Ensure pets are secured during service visits
- Provide accurate information about your property and electrical systems
- Obtain any necessary permits or approvals (where applicable)
- Inform us of any special requirements or concerns
9. Limitation of Liability
9.1 No Liability for Contractor Actions
Great White Electrical is NOT liable for:
- Any work performed (or not performed) by referred contractors
- Quality, safety, or compliance issues with contractor work
- Damage to property caused by contractors
- Personal injury or death resulting from contractor work
- Financial losses due to contractor actions or inactions
- Contractor breaches of contract or agreements
- Contractor insolvency or business failure
- Disputes between customers and contractors
9.2 Contractor Insurance
Each contractor maintains their own insurance coverage. We recommend verifying that any contractor you engage has:
- Current public liability insurance
- Workers' compensation insurance (if applicable)
- Valid electrical licenses and certifications
9.3 Maximum Liability
To the maximum extent permitted by law, Great White Electrical's total liability to you for any claim arising from our referral service is limited to $100 AUD.
9.4 AS-IS Service
Our referral service is provided "AS-IS" without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Contractor Compliance
While we make reasonable efforts to refer licensed contractors, Great White Electrical does not verify or guarantee that contractors:
- Comply with Australian/New Zealand Wiring Rules (AS/NZS 3000)
- Follow Western Australian electrical safety regulations
- Adhere to Building Code of Australia (BCA) requirements
- Maintain current licenses and certifications
- Carry adequate insurance
It is your responsibility to verify contractor credentials before engaging their services.
11. Dispute Resolution
11.1 Disputes with Great White Electrical
If you have a complaint about our referral service, please contact us directly. We will make reasonable efforts to address your concerns.
11.2 Disputes with Contractors
For disputes regarding electrical work, pricing, quality, or any other matter related to a contractor's services, you must deal directly with the contractor. Great White Electrical cannot and will not mediate, arbitrate, or otherwise involve itself in disputes between customers and contractors.
For contractor-related disputes, you may:
- Contact the Department of Mines, Industry Regulation and Safety (DMIRS)
- Seek advice from Consumer Protection WA
- Engage mediation or legal services independently
12. Intellectual Property
All content on our website, including text, graphics, logos, and images, is the property of Great White Electrical and protected by Australian intellectual property laws. You may not reproduce, distribute, or use our content without written permission.
13. Privacy
Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal information.
14. Force Majeure
We are not liable for delays or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters
- Severe weather conditions
- Government actions or restrictions
- Labor disputes
- Material shortages
- Pandemics or public health emergencies
15. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
16. Governing Law
These Terms and Conditions are governed by the laws of Western Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
