1. Agreement to Terms
By accessing and using the services of Great White Electrical ("Company," "we," "our," or "us"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
2. Nature of Service - Booking, Scheduling & Service Delivery
Great White Electrical provides electrical services to customers in Perth and surrounding areas by booking, scheduling, coordinating attendance, and arranging for appropriately licensed electricians to carry out the electrical work.
2.1 What We Do
Great White Electrical provides the following services:
- Customer enquiries, booking, and scheduling
- Dispatch and coordination of attendance
- Initial consultation and requirement gathering
- Quoting (where possible) and communicating job requirements
- Arranging for a licensed electrician to attend and perform the work
2.2 What We Do NOT Do
Great White Electrical does NOT:
- Personally carry out electrical work unless performed by a licensed electrician
- Issue electrical compliance certificates in our own name
- Provide technical instructions that override the licensed electrician's professional judgement
2.3 Licensed Electricians and Subcontractors
Electrical work may be performed by licensed electricians engaged for the job, including independent licensed electrical contractors (subcontractors). Where subcontractors are used, they:
- Hold their own electrical licenses and qualifications
- Carry their own insurance and liability coverage
- Are responsible for the technical performance, testing, and certification of the electrical work they perform
2.4 Certification
Any required electrical certificates, test results, and compliance documentation are issued by the licensed electrician who performs and certifies the work (as applicable).
3. Quotes, Scope and Variations
3.1 Quotes
We may provide estimates or quotes based on the information you provide. Final pricing may require an on-site assessment by the licensed electrician.
3.2 Variations
If additional work is required, or the scope changes after the electrician attends site, we will communicate the variation to you. No additional chargeable work should proceed without your approval (except where urgent safety work is required to make the site safe).
3.3 No Guarantee of Availability
While we will do our best to schedule promptly (including for emergencies), availability depends on workload, location, and the nature of the job.
4. Booking and Scheduling
Service bookings can be made via phone, email, or through our website. We will confirm your booking and provide an estimated arrival time. While we strive to meet all scheduled appointments, times are approximate and may be subject to change due to:
- Previous job overruns
- Emergency call-outs
- Weather conditions
- Traffic or unforeseen circumstances
We will notify you as soon as possible if your appointment needs to be rescheduled.
5. Payment and Fees
5.1 Fees and Invoicing
We may charge a call-out fee, fixed-price service fees, and/or quoted amounts for electrical work. Where applicable, we will provide an invoice for work completed.
5.2 Payment Terms
Unless otherwise agreed in writing, payment is due upon completion of work. For larger projects, we may request a deposit or staged payments.
6. Cancellations and Rescheduling
6.1 Customer Cancellations
If you need to cancel or reschedule an appointment, please provide at least 24 hours' notice. Cancellations with less than 24 hours' notice may incur a cancellation fee.
6.2 Company Cancellations
If we need to cancel or reschedule your appointment, we will provide as much notice as possible and work with you to find an alternative time.
7. No Warranties or Guarantees from Great White Electrical
7.1 Workmanship and Materials
To the extent permitted by law, workmanship warranties and manufacturer warranties apply as provided for the job. Warranty terms may differ depending on the work performed and materials supplied.
7.2 Certification Responsibility
Technical compliance, testing, and certification (where required) are the responsibility of the licensed electrician performing the work.
7.3 Follow-up and Remedial Work
If you have a concern about work completed, please contact us promptly. We will liaise with the licensed electrician who performed the work to assess and (where applicable) arrange remedial action.
8. Customer Responsibilities
As a customer, you agree to:
- Provide safe and reasonable access to work areas
- Disclose any known electrical issues or hazards
- Ensure pets are secured during service visits
- Provide accurate information about your property and electrical systems
- Obtain any necessary permits or approvals (where applicable)
- Inform us of any special requirements or concerns
9. Limitation of Liability
9.1 No Liability for Contractor Actions
Great White Electrical is NOT liable for:
- Any work performed (or not performed) by licensed electricians engaged for the job
- Quality, safety, or compliance issues with contractor work
- Damage to property caused by contractors
- Personal injury or death resulting from contractor work
- Financial losses due to contractor actions or inactions
- Contractor breaches of contract or agreements
- Contractor insolvency or business failure
- Disputes between customers and contractors
9.2 Contractor Insurance
Each contractor maintains their own insurance coverage. We recommend verifying that any contractor you engage has:
- Current public liability insurance
- Workers' compensation insurance (if applicable)
- Valid electrical licenses and certifications
9.3 Maximum Liability
To the maximum extent permitted by law, Great White Electrical's total liability to you for any claim arising from our services is limited to $100 AUD.
9.4 AS-IS Service
Our services are provided "AS-IS" without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Contractor Compliance
While we make reasonable efforts to arrange appropriately licensed electricians, Great White Electrical does not guarantee that contractors:
- Comply with Australian/New Zealand Wiring Rules (AS/NZS 3000)
- Follow Western Australian electrical safety regulations
- Adhere to Building Code of Australia (BCA) requirements
- Maintain current licenses and certifications
- Carry adequate insurance
It is your responsibility to verify contractor credentials before engaging their services.
11. Dispute Resolution
11.1 Disputes with Great White Electrical
If you have a complaint about our services, please contact us directly. We will make reasonable efforts to address your concerns.
11.2 Disputes with Contractors
For disputes regarding electrical work, pricing, quality, or any other matter related to a contractor's services, you must deal directly with the contractor. Great White Electrical cannot and will not mediate, arbitrate, or otherwise involve itself in disputes between customers and contractors.
For contractor-related disputes, you may:
- Contact the Department of Mines, Industry Regulation and Safety (DMIRS)
- Seek advice from Consumer Protection WA
- Engage mediation or legal services independently
12. Intellectual Property
All content on our website, including text, graphics, logos, and images, is the property of Great White Electrical and protected by Australian intellectual property laws. You may not reproduce, distribute, or use our content without written permission.
13. Privacy
Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal information.
14. Force Majeure
We are not liable for delays or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters
- Severe weather conditions
- Government actions or restrictions
- Labor disputes
- Material shortages
- Pandemics or public health emergencies
15. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
16. Governing Law
These Terms and Conditions are governed by the laws of Western Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
